GAME CONCEPT: The Challenge Magazine Fantasy League Racing Game is a game of skill, and winners will be determined by the objective criteria set forth herein. From all eligible entries received, winners will be determined by the participant who uses his or her knowledge of the historical events surrounding NASCAR Sprint Cup, Nationwide and Craftsman Truck Series racing, including relative strengths and weaknesses, to accumulate the most points during the game term as defined below. Game may not be used in any form of gambling. The game has no affiliation with the NASCAR sanctioning body and does not present itself as being licensed, sanctioned, approved or controlled by those bodies. The NASCAR logo, 'NASCAR,' and the National Association for Stock Car Auto Racing are registered trademarks of their respective owners.

GAME OPERATORS: The Challenge Magazine Fantasy League Racing Game is the sole property of Challenge Magazine, 650 SW Broad Street, Southern Pines, NC 28387. 

CONTEST TERM:  Entries for contest term will be accepted beginning Monday, June 30th 2008 and ending at 12:00 Noon EST on Friday, November 14th, 2008.  Official contest period begins with the NASCAR races held on the weekend of September 13-14 and ends with the NASCAR races of November 14-15-16, 2008.  Starting lineups for all seven drivers must be submitted no later than 12:00 Noon EST (11:00 AM during Daytlight Savings Time) on the day of the first race of each weekend/round. In case of rescheduled race events, this deadline may be extended at the discretion of the Commissioner. (See 'Terms of Service')

WEEKLY ENTRY DEADLINES: Players can change their driver selections at anytime up to 12:00 Noon EST on the day of the first race of each weekend or round.  At 12:00 Noon EST on the day of each race weekend/round’s first race from the Cup, Nationwide and Truck series, the site changes to show the player's selected drivers for that weekend/round’s race(s) and allow players to select drivers for the next weekend/round of races.

SCORING RULES: Using his or her knowledge of the history, occurrences and changes divulged from public information records related to NASCAR Sprint Cup, Nationwide and Craftsman Truck Series racing, each participant selects seven (7) drivers for each race weekend throughout the last 10 race weekends of the 2008 season, from the weekend/round of the September 13-14 NASCAR Nationwide and Sprint Cup races at Loudon, NH through the final weekend/round of racing featuring NASCAR Sprint Cup, Nationwide and Craftsman Truck Series races at Homestead, FL. Participants must select at least one driver per series racing each weekend/ round in order to complete their full seven-driver team. Participant will earn points according to finishing position of selected drivers at conclusion of race event(s). Driver points are only awarded to the top 16 finishers per race. Points are awarded for finishing position (1st place = 160 pts., 2nd place = 150 pts., 3rd place = 140 pts, etc.), qualifying (Pole qualifier receives 55 bonus pts., 2nd-fastest receives 44 bonus points, 3rd -fastest receives 33 bonus points, 4th -fastest receives 22 bonus points, 5th-fastest receives 11 bonus points), lap leader (any driver that leads an official lap earns 22 bonus points; driver who leads the most laps earns 44 bonus points), and manufacturer (winning driver earns 55 bonus points for driving the first of that type of car, driver of the next different type of car receives 44 bonus points, driver of 3rd different type of car receives 33 bonus points, driver of 4th different type of car receives 22 bonus points, driver of 5th different type of car receives 11 bonus points; for spec series, with only one car, manufacturer points are awarded in descending order to the first, second, third, fourth and fifth-place drivers. Drivers are only eligible for bonus points if they finish in 16th place or higher. Participant scores are the cumulative total of all selected driver's points per weekend/round. Players who do not select drivers will not receive any points for that weekend/round.

ODDS OF WINNING: Chances of winning weekly and championship prizes depend upon the total number of entries received and the skill used in selecting drivers.

PRIZES: Prizes will be awarded on a weekly and end-of-season basis during the official contest period.  Weekly Top Dawg prizes will be awarded to the top 10 point-scoring teams each weekend/round; one prize per player/team per category; a tie-breaking system will determine  winner(s) in case of duplicate scores. Top Dawg prizes for most points will be awarded for all 10 weekends/rounds that comprise the official game period.  Championship prizes will be awarded to the three entrants that score the most cumulative points during the 10-weekend/round game period, beginning with the Sept. 13-14 NASCAR races at Loudon, NH and ending with the final three NASCAR races of the season at Homestead, FL, November 14-16. Prizes are not transferable and must be accepted as awarded, no cash equivalents, no substitutes, except as determined by Challenge Magazine in its sole discretion. Winners must be domiciled residents of the United States to be eligible for prizes.  All winners automatically grant to Challenge Magazine the right to use their name, address and photo for publicity without compensation. Any and all federal, state, and local taxes in connection with the prizes are the sole responsibility of the winners. All costs and expenses not specified herein related to the acceptance and use of the championship prize(s) are the sole responsibility of the winner.  Prize winners may receive a tax Form 1099-M and be required to sign an affidavit of eligibility and a liability release within ten (10) days of notification. In the event of non-compliance, the prize will not be awarded. Neither organizers nor sponsors are responsible for any damages or injury incurred by a Challenge Magazine Fantasy League Racing entrant as a result of winning. 

Top Dawg Prizes (best score each week, among all players, during official game period):
• 1st Place (most points) –  $25 Pilot Gas Card, Challenge Magazine Fantasy League Racing t-shirt
• 2nd-10th Place (in points) –  $25 Pilot Gas Card

Championship Prizes: At the end of the official game period, the top three players who have accumulated the most points will receive:
• 1st Place Prize – Pilot $2500 Gas Card, Challenge Magazine Fantasy League Racing t-shirt
• 2nd Place Prize – One-day Richard Petty Driving Experience, t-shirt
• 3rd Place Prize – Two tickets to the February 2009 NASCAR Cup race at Daytona, FL (travel and lodging expenses not included), t-shirt

HOW TO ENTER: Entries can only be accepted after registration at the Challenge Magazine Fantasy League Racing website, at www.ptcchallengefmfl.com.. All fields must be completed on entry form. Only one registration per person. Participants will be provided with a password to permit access to the website and game play. In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized password holder submitted at time of entry. The authorized password holder is defined as the living person who is assigned an e-mail address by an Internet access provider, online service provider or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. After registration, participants can play the game. Participants will use their password to enter the Members Only area to log in and select drivers for each weekend/round and to review scores. By entering the game participants grant game operators the right to use and publish your proper name online and in another other media in connection with the game.

ELIGIBILITY: Challenge Magazine Fantasy League Racing  Game participants must be 18 years of age or older as of September 13th, 2008 and must be legal residents of the fifty (50) United States and the District of Columbia, excluding Puerto Rico and/or other municipalities where game is void by law.  All employees and immediate family members of Challenge Magazine, including the sponsors, advertising, production, and fulfillment agencies are not eligible for prizes. Challenge Magazine reserves the right to disqualify any entry form that is incomplete or incorrect.  Prize winners must have a valid, unblocked email address.  Only one entry per person; players must have valid, unrestricted email address.  Void where prohibited or restricted by law. Those excluded based on residence criteria may play, but WILL NOT be eligible to receive any prizes and/or be designated the winner of any round, quarter or championship; players found to be ineligible to win prizes will be dismissed from Game results and prizes will be awarded to the eligible player with the highest points per prize category.

COST TO ENTER AND PARTICIPATE:  There is no fee to enter and participate in the Challenge Magazine Fantasy  League Racing Game. Participants must register for membership at the Challenge Magazine Fantasy League Racing website to participate. Membership allows the player to select seven (7) drivers for each of the weekends/rounds of Challenge Magazine Fantasy Racing League play. Throughout the season, beginning prior to the first weekend/round of racing, and through the week prior to the last week or round of racing, players may select any or all seven drivers for one weekend/round’s play. Players must select drivers each week to earn points. Players must select at least one driver per series scheduled. Driver selections can be made prior to 12:00 Noon EST on the day of the first race of each weekend/round.

TIE-BREAKERS: Should a tie exist between two or more entrants the winner will be determined as the player or participant who had the higher score for his or her selected drivers for the previous weekend/round of play. If a tie persists, the team with the highest score for the weekend/round previous to that will be declared the winner, and so on, and so on, until a winner is determined.  If there is a tie among one or more players for the first round of play the winner or winners or rankings will be determined by earliest registration date.
 
THE COMMISSIONER'S OFFICE: An official standards and practices committee called The Commissioner's Office has been established to govern the rules and play of the Challenge Magazine Fantasy League Racing Game. You may address any questions, discrepancies, concerns or suggestions via email to commish@ptcchallengefmfl.com or via postal mail to Challenge Magazine Fantasy League Racing, P.O. Box 12523, Tempe, AZ 85284. The Commissioner's Office reserves the right to adjust any rule if such an adjustment best serves all competitors. The Commissioner's Office also reserves the right to disqualify or refuse service to anyone if there is any evidence of tampering or manipulation.

ERRORS: In the event that you believe The Commissioner's Office has made an error, it is the sole responsibility of you, the Challenge Magazine Fantasy League Racing participant, to inform The Commissioner's Office within seven days of the end of the Challenge Magazine Fantasy League Racing League weekend or round in which you believe the error occurred. All efforts will be made to correct the error; however the decision of The Commissioner's Office is final.

PUBLICITY: Challenge Magazine reserves the right to use entrant's names for publicity. Winners automatically grant to Challenge Magazine the right to use their name and likeness in advertising and promotion of this event without further permission or compensation unless prohibited by law.

SCHEDULE CHANGES: Challenge Magazine will not be responsible for Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control, which may cause the cancellation of any Sprint Cup, Nationwide or Craftsman Truck Series event. For any reason and without notice, Challenge Magazine reserves the right to cancel the Challenge Magazine Fantasy League Racing Game without compensation.

GAMBLING: The Challenge Magazine Fantasy League Racing Game may not be used for any form of gambling.

GENERAL: By registering to play in the Challenge Magazine Fantasy League Racing Game, you (1) acknowledge acceptance of these rules and agree to adhere to and be bound by them, and (2) release, and waive any rights of recovery against or in connection with Challenge Magazine and its respective sponsors, contractors, agents, officers, and employees from and against any claims, expenses, damages and/or liability incurred by you in connection with or related to the operation of, or your participation in the Challenge Magazine Fantasy League Racing Game and (3) agree to hold Challenge Magazine harmless from all typographical, statistical, transaction, and communication errors or omissions, and Challenge Magazine reserves the right to disqualify any participant for suspected cheating or non-adherence to these Official Rules.

ADDITIONAL LEGAL DISCLAIMERS:  The Challenge Magazine Fantasy League Racing Game is open to legal residents of the fifty (50) United States and the District of Columbia, excluding Puerto Rico; players must be 18 years of age or older (if the age of a majority in a jurisdiction is different than 18, you must be of the age of majority within your jurisdiction to be eligible to receive a prize) with a valid internet e-mail address as of 12:00 Noon EST on September 13th, 2008. Void where prohibited or restricted by law. Those excluded based on residence criteria may play, but WILL NOT be eligible to receive any prizes and/or be designated the winner of any round, quarter or championship. By entering, each entrant accepts and agrees to be bound by these rules and by the decision of the judges which shall be final and binding in all respects. Any and all federal, state, and local taxes in connection with the prizes are the sole responsibility of the prize winners. No substitution or transfer of prizes permitted except by Challenge Magazine; Challenge Magazine reserves the right to substitute a prize for one of equal or greater value in the event that an advertised prize is unavailable. All prize winners may be required to submit valid identification to Challenge Magazine and to execute an affidavit of eligibility and a liability/publicity release within ten (10) days following attempted notification. Failure to comply within this time period may result in disqualification and awarding of the prize to the entrant with the next highest score.

All federal, state and local laws and regulations apply. Challenge Magazine is not responsible for lost, late or misdirected online entries, for incorrect, inaccurate or incomplete entry information whether caused by a contestant, equipment, or technical malfunction or for any human error, technical error or malfunctions. Challenge Magazine reserves the right to halt the Game at any time during the contest period for any reason. In the event that a scheduled race is canceled or preempted for any reason, no points will be awarded for that week for selected drivers on the affected teams.

Challenge Magazine is not responsible for typographical or other human or technical errors in the offer or administration of this Game, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the winner or the distribution of the prizes.  Challenge Magazine reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Game.  If any modification to the rules occurs, registered participants will be notified via e-mail to the e-mail address on record at the time of notification.  If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Challenge Magazine which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Game, Challenge Magazine reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, or suspend the Game. In such event, Challenge Magazine further reserves the right to award the championship prizes to the player or players with the most points, as of the termination date.

Challenge Magazine assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Challenge Magazine is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any Web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Game. CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CHALLENGE MAGAZINE RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.

In the event of a dispute, entries will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Challenge Magazine reserve the right to halt, modify, or suspend the Game at any time due to situations beyond the control of sponsors such as strikes, acts of God, etc.  In the event that the Game is challenged by any legal or regulatory authority, Challenge Magazine reserves the right to discontinue or modify the Game, or to disqualify participants residing in the affected geographic areas. In such event, Challenge Magazine shall have no liability to any players who are disqualified due to such an action. 

DISCLAIMER OF WARRANTIES: You expressly understand and agree that:  Your use of the service is at your sole risk.  The service is provided on an "as is" and "as available" basis.  Challenge Magazine expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  Challenge Magazine makes no warranty that (i) the service will meet your requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (ii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material obtained by you through the service will meet your expectations, and (v) any errors in the software will be corrected.

LIMITATION OF LIABILITY: You expressly understand and agree that Challenge Magazine is solely responsible for all aspects of this game, and that Challenge Magazine shall not be liable to you for any direct, indirect, incidental, special, consequential or exemplary damages, including but no limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Challenge Magazine has been advised of the possibility of such damages), resulting from: (i) the use of the inability to use the service; (ii) unauthorized access to or alteration of your transmissions of data; (iii) statements of conduct of any third party on the service; or (iv) any other matter relating to the certain warranties of the limitation of exclusion of liability for incidental of consequential damages.  Accordingly, some of the above limitations may not apply to you.

DISCLAIMERS; LIMITATIONS ON LIABILITY; DISQUALIFICATION: No damage, loss, injury or responsibility is assumed by Challenge Magazine or any subsidiary and/or affiliated company of any of the foregoing (collectively, the Released Parties) for any of the following: 1) Incomplete, late, lost, damaged or misdirected entries; 2) Any printing or typographical errors in any materials associated with the game; 3) any computer malfunction, bug, error, virus, or any other technical malfunction and/or problem; or 4) any use of the prizes. By participating in the game, you (and if you are a minor, your legal guardians or parents) release and agree to hold harmless the released parties from any liability whatsoever for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the game (including the software associated with it) or acceptance, possession, or use of any prize (including, without limitation, claims, costs, injuries and losses related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Challenge Magazine reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Lowe's in asserting any available defenses. Challenge Magazine reserves the right at its sole discretion to disqualify any individual they find to be tampering with the entry process or the operation of the game; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. ANY ATTEMPT BY A PLAYER/PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY ALTER OR DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GAME IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CHALLENGE MAGAZINE AND MOTORSPORTPROMOS RESERVE THE RIGHT TO DISQUALIFY SUCH INDIVIDUAL AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

TERMS OF SERVICE: The Challenge Magazine Fantasy League Racing Game will act as League Commissioner and as such will retain the right as final authority on all matters relating to the game. The Commissioner will have the power to rule on all aspects of the game including, but not limited to: League business, registered drivers, infractions of the rules and disputes among players/participants. The decisions of the Commissioner shall be final and irreversible. Use of this site constitutes your acceptance of these terms and conditions, which take effect on the date you first use this site. Challenge Magazine reserves the right to change these terms and conditions at any time without notice and will post all changes online. You accept sole responsibility for reviewing information posted online in order to obtain timely notice of such changes. Your continued use of this site after any and all changes are posted constitutes your acceptance of this agreement as modified by the posted changes.

OWNERSHIP GUIDELINES: There are certain responsibilities that come along with owning a Challenge Magazine Fantasy League Racing team. When you as a player create a team, you are responsible for that franchise. Any and all conduct associated with your team will be your responsibility, as it is your responsibility to keep track of all occurrences and changes within the sport so you can manage your team accordingly. It is your sole responsibility to make certain that you have selected your drivers prior to the cutoff date for each week or round. The Challenge Magazine Fantasy League Racing Game will not tolerate obscenities, vulgarity, harassment, or any other violation of the aforementioned terms of service. Violations of these terms of service can result in an initial warning communicated by e-mail or your removal from the league. By posting or submitting content to this site you grant Challenge Magazine and its affiliates and licensees the right to use, reproduce, display, perform, adapt, modify, distribute, have distributed, and promote the content in any form, anywhere and for any purpose; and warrant and represent that you own or otherwise control all of the rights to the content and that public posting and use of your content by Challenge Magazine will not infringe or violate the rights of any third party.

THIRD PARTY SITES: This site may link you to other sites on the Internet, which may contain inappropriate, inaccurate, or offensive information or material. These sites are not under the control of Challenge Magazine and you acknowledge that Challenge Magazine is not responsible for the decency, legality, copyright compliance, accuracy, or any other aspect of the content of these sites. The use and inclusion of other links on this site does not in any way imply endorsement or association with those sites or their operators.

RULES: This game is subject to these complete Official Rules and all applicable federal, state, and local laws and regulations. The terms of use shall be governed by and construed in accordance with the laws of the State of Arizona, excluding its conflict of law rules. You expressly agree that the exclusive jurisdiction for any claim or action arising out of or relating to these terms of use or your use of this site shall be filed only in the state or federal courts located in the State of Arizona, and you further agree and submit to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action. By participating in this game you acknowledge that you have read the rules and agree to abide by their terms and by the decisions of Challenge Magazine, which are final and binding on all matters pertaining to this game. Unless otherwise specified herein, this agreement constitutes the entire agreement between you and Challenge Magazine with respect to this site and supersedes all prior or contemporaneous communications and proposals, whether electronic, written/printed, or oral, between you and Challenge Magazine with respect to this site. If any part of these terms of use in held invalid or unenforceable, that portion may be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. Challenge Magazine reserves the right, in its sole discretion, to terminate your access to all or part of this site, with or without notice.
